Introduction
AI governance globally is polarizing between two unstable poles: authoritarian state control and voluntary private self-regulation. Both models present structural risks. While authoritarian AI governance concentrates power in the state, self-regulatory governance in liberal democracies centralizes power within private frontier labs (UN High-level Advisory Body on AI, 2024; OECD, 2024). Neither model adequately addresses the accountability deficits emerging in frontier AI deployment.
Authoritarian AI Governance
In state-centered models—such as China’s—AI governance is integrated into broader political control mechanisms:
- Content regulation: Algorithms are required to reinforce state ideological narratives.
- Licensing regimes: Model deployment requires state approval (Cyberspace Administration of China, 2023).
- Alignment objectives: The state defines acceptable model outputs, particularly in generative and language models (Kania & Laskai, 2023).
While such models allow tight control over deployment and proliferation, they suppress independent safety research, restrict open scientific inquiry, and subordinate AI development to political stability objectives (UNESCO, 2023; UN High-level Advisory Body on AI, 2024).
The Illusion of Open Governance
In contrast, Western AI governance has emphasized private-sector leadership, voluntary safety frameworks, and public-private partnerships (GPAI, 2024; OECD, 2024). But these open governance narratives obscure several core vulnerabilities:
- Private control over model access and safety evaluations (Anthropic, 2024; OpenAI, 2024).
- Lack of binding disclosure obligations (UN High-level Advisory Body on AI, 2024).
- Structural capture of regulatory advisory processes by dominant labs (Cihon et al., 2024).
While presented as flexible and innovation-friendly, this model often relies on the goodwill of private actors rather than enforceable legal institutions (OECD, 2024).
Why Neither Model Is Stable
Both authoritarian and open-governance models share critical weaknesses:
- Accountability deficits: Neither model ensures independent, legally empowered safety verification.
- Public exclusion: Citizens and independent researchers lack meaningful access to model safety evaluations.
- Epistemic asymmetry: Control over safety-relevant knowledge remains centralized in either state bureaucracies or corporate labs.
As frontier AI models increase in power, both models risk consolidating unaccountable control over systems that deeply affect social, political, and economic life globally (UN High-level Advisory Body on AI, 2024; Cihon et al., 2024).
Toward Institutionalized Democratic Oversight
Escaping this binary requires institutional solutions that embed enforceable public oversight into frontier AI governance:
- Statutory safety disclosure regimes.
- Legally protected adversarial safety research.
- Independent model evaluation authorities with full technical access.
- Transparent global safety registries.
- Public representation in international governance bodies (GPAI, 2024; OECD, 2024; UNESCO, 2023).
Only robust, law-backed institutions can ensure that AI governance balances safety, innovation, and democratic accountability.
Conclusion
Both authoritarian control and laissez-faire open governance leave AI safety governance structurally fragile. One concentrates power in the state; the other in private corporate labs. The future of global AI governance requires enforceable legal institutions that democratize oversight, distribute epistemic authority, and stabilize public accountability in the face of rapidly scaling AI capabilities.
